Terms and Conditions
1.
In these terms of business the following terms have the meanings set out opposite them:-

The Agency = Aupair2u, Luciandra, West Ednie, St. Fergus, Peterhead, Aberdeenshire, AB42 3BX

Au pair = A young person aged between 17 and 27 who meets  the requirements laid down in the Home Office Immigration Scheme and Nationality Department Rules regarding the admission of Au pairs to the United Kingdom.

The Client = the person or persons making the application to the Agency for the introduction of an Au pair and/or to whom the Au pair is introduced.

Aupair2u is an introductory agency only and therefore does not employ directly any of the applicants. Applicants are introduced to clients on the basis that they will be invited to join the Host Family under the Government Au Pair Scheme.

The Agency will only consider applications submitted on the Agency's own application form as supplied to the client. The Agency reserves the right to require additional information from the client.
4.
Where a client's interest has been registered with the Agency, the Agency will endeavour to supply the client with details of at least three potential Au pairs as soon as possible. This figure is not always guaranteed as supply varies throughout the year.
5.
Agency proceeds in all cases on the basis of the information contained in the application form. It is the client's responsibility to ensure that the information in the application form is full and correct.
6.
When the client has decided on an Au pair or Au pair couple that they wish to invite to the United Kingdom, the client must first contact the Agency to obtain confirmation that the Au pair is available and authorisation to approach the Au pair. Once authorisation has been given by the Agency to approach the Au pair, the client will be solely responsible for inviting the Au pair to the client's home and except as provided in these terms of business for agreeing with the Au pair the terms and conditions for his/her stay in the United Kingdom with the client. The Agency has advised all potential Au pairs that the minimum "pocket money" paid by a client to an Au pair will be £50.00 per week unless from outside the Au pair scheme. All clients are deemed to have undertaken to pay at the correct rate.

Unless the client advises the Agency to the contrary, within fourteen days of receiving authorisation to approach the Au pair, the Agency will assume that the client has engaged the Au pair and will invoice the client accordingly. The current Agency fees are -:

Au pair - Single
Up to 3 months      £175 Sterling
3 to 5 months        £225 Sterling
6 to 12 months       £250 Sterling
13 to 24 months     £295 Sterling

Au pair – Couple
Up to 3 months      £300 Sterling
3 to 12 months       £500 Sterling
13 to 24 months     £600 Sterling

All fees are payable within seven days of the date of invoice.
Au pairs will not be authorised to travel by the Agency until cleared funds have been received. Remember, time is of the essence, any delay may result in the Au pair being offered to another Host Family.
Details of potential Au pairs are provided for the use only of the client and if that client passes these details to a third party, who subsequently engages one of the Au pairs, the client remains liable to the Agency for the fee due to the Agency, in terms of this condition, as if the client had engaged the Au pair. The Agency keeps in regular contact with all Au pairs before, during and after placement.

8.
(a) If the Au pair leaves the client's home within twenty one days of the commencement of the placement, the Agency will use its best endeavours to offer the client a replacement Au pair. If the Agency is unable to offer a replacement Au pair, it will, subject to the terms of sub-clause
(b), refund one half of the fee paid by the client to the Agency. The Agency will not refund any part of the fee paid where a replacement Au pair is not accepted by the client;

(b) No refund of any fee paid will be made should the Au pair leave the client's home after (i) fourteen days from the commencement of the placement where the placement is for a period of up to three months and (ii) twenty one days from the commencement of the placement in all other cases;

(c)Where the Au pair accepts a client's invitation to travel to the United Kingdom and fails to arrive, the provisions of sub-clause (a) will apply with regard to the Agency offering a replacement and the possible repayment of any fee paid;
and

(d) No repayment of fee will be made where the client issues an invitation to an Au pair which is accepted and thereafter cancels that invitation prior to the Au pair travelling to the United Kingdom.
9.
The Agency assesses all potential Au pairs on the basis of information provided either by the Au pairs or by reputable agencies in their home countries. Whilst The Agency strives to ensure the validity of all applications it has no way of checking the accuracy and reliability of information provided by applicants other than the request of references and police checks - and the Agency gives no warranty as to the suitability of applicants or their ability or willingness to fulfil their responsibilities in terms of any agreement which the Au pair may reach with the client. Again the Agency strives to select only suitable Au pairs to fill the roles required.
In no circumstances will the Agency be liable for any action of the Au pair while the Au pair is resident with a client in the United Kingdom. Any client unsure about the effect of engaging an Au pair on any insurance cover which the client may have should contact their insurance adviser prior to engaging the Au pair.

10.
If a Host family engages an Au pair and through that Au pair engage another for themselves or for another host family then the original host family will be invoiced immediately for a 6 to 12 month placement at £250.

11.
Au pairs are not qualified, professional baby sitters and as such should not be left alone with babies or children for extended periods of time.
